EU / UK residents

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases:

  • Consent: where you have given us permission to use your personal information for a specific purpose. You can withdraw your consent at any time.
  • Performance of a contract: where necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract.

4. When and with whom do we share your personal information?

We may share information in specific situations described in this section and/or with the following third parties:

5. How long do we keep your personal information?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. Do we collect information from minors?

We do not knowingly collect data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. Opting out of marketing communications

You will then be removed from the marketing lists. We may still communicate with you for service-related, non-marketing purposes.

Account information

If you would at any time like to review or change the information in your account or terminate your account, you can contact us using the contact information provided. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. We may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, and/or comply with applicable legal requirements.

9. Controls for Do-Not-Track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

10. Do Virginia residents have specific privacy rights?

Yes. If you are a resident of Virginia, you may be granted specific rights regarding access to and use of your personal information under the Virginia Consumer Data Protection Act (CDPA). Under the CDPA, "consumer" means a natural person who is a resident of the Commonwealth acting only in an individual or household context (it does not include a natural person acting in a commercial or employment context).

Your rights with respect to your personal data include:

  • Right to access your personal data
  • Right to correct inaccuracies in your personal data
  • Right to request deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us

Gondola Markets Inc. has not sold any personal data to third parties for business or commercial purposes and will not sell personal data belonging to website visitors, users, and other consumers in the future. Upon receiving your request, we will respond without undue delay and within forty-five (45) days of receipt; the response period may be extended once by forty-five (45) additional days when reasonably necessary. If we decline to take action, you may appeal by emailing legal@gondolamarkets.com; if your appeal is denied, you may contact the Attorney General to submit a complaint.

Yes. We may update this privacy notice from time to time, and the updated version will be effective as soon as it is accessible.
